Terms of Service

HuddleEats is a software platform that facilitates marketplace orders between families and independent third-party food vendors (restaurants and caterers). We provide scheduling, ordering, headcount consolidation, and payment-facilitation technology.

HuddleEats does not prepare, sell, handle, or deliver food, and is not a party to the sale of any meal. The vendor is the seller. We are not a reseller of food.

For every order, the independent vendor you select is the sole seller and merchant of the food. The vendor is solely responsible for the food it sells — including its preparation, quality, safety, ingredients, allergen accuracy, packaging, and fulfillment. Menus, prices, minimums, lead times, and delivery terms are set by the vendor.

Your contract for the purchase of food is with the vendor. HuddleEats’s role is limited to facilitating the order and the payment for it.

Payments are processed through our third-party payment processor, Stripe, which acts as the licensed money transmitter. When your card is charged, the food price and applicable tax are routed to the vendor’s connected account; HuddleEats’s service fee is collected separately.

HuddleEats does not custody your funds. Money does not land in a HuddleEats bank account, and there is no stored balance, wallet, or account credit. You authorize HuddleEats to initiate charges to your payment method for the meals you select, including scheduled charges when a game’s ordering window closes.

HuddleEats charges a flat service fee per athlete meal for use of the Platform. The exact fee and the full order total — vendor food price, applicable tax, and service fee — are shown to you before you place or confirm each order.

HuddleEats is a marketplace provider under Texas law. For orders placed through the Platform, HuddleEatscalculates, collects, and remits the applicable state and local sales tax — on both the food and the HuddleEatsservice fee — directly to the taxing authority. The tax is shown as part of your order total before you confirm.

Because HuddleEats collects and remits the marketplace sales tax, the vendor does not separately remit sales tax on sales made through the Platform. HuddleEats certifies to each vendor that it assumes responsibility for collecting and remitting Texas sales tax on marketplace sales made through the Platform.

Certain purchases made and paid for directly by a tax-exempt organization (such as a school, or a booster club that holds its own exemption) using its own funds, with valid exemption documentation on file, may be exempt. A purchase paid for by an individual — for example, a parent buying their own athlete’s meal — is not exempt, even if the meal is served at a school or team event.

If you need to cancel or change an order, do so before the order cutoff for that game. To request a refund, use the refund option inside the app so we can process it quickly against the original order. Please contact us through the app before initiating a chargeback with your bank — most issues are resolved faster in-app, and a bank chargeback can delay resolution.

Athletes do not have accounts, do not log in, and are never contacted through the Platform. Athlete records are created and managed only by an adult (a parent or a coach). This is a deliberate design choice to keep children out of scope for online-account data collection.

We may update these Terms from time to time. When we do, we will revise the version and effective date above. Your continued use of the Platform after an update means you accept the revised Terms.
